PURPOSE OF LETTER
AND BACKGROUND

The Kansas Commodity
Distribution Manual (KCDM) has been revised to incorporate the
new 1999 poverty income guidelines, to update Distribution Area
Contact Information on Exhibit A-2, and to add two statements to
Exhibits B and C. The following will be added to Section 11, Part
B of Exhibit B, and Section II, Part B of Exhibit C:
In addition the participating organizations agrees that all food will be
distributed and used in accordance with 7 CFR Part 250 of the Regulations
for Food Distribution.
The following will be added
to Section II, Part H of Exhibit B, and Section II, Part H of Exhibit
C:
These changes will be effective
for all Federal Fiscal Year 2000 agreements to distribute commodity
foods under The Emergency Food Assistance Program (TEFAP).
CHANGES
Income Guideline Revision
Federal regulations and
the TEFAP Kansas State Plan require that eligibility be determined
based upon a household's total gross monthly income. Households with
a maximum gross monthly income of 130% of the federal poverty level
are potentially eligible. Due to the annual publication of the new
federal poverty level guidelines for 1999, it is necessary to revise
our income eligibility standards. We are revising the Kansas Commodity
Distribution Manual (KCDM), Section 2303, Income Standards, and Section
8000, Exhibit E. Exhibit E is the TEFAP Declaratory Statement/Inventory
Control form which is used in order to determine program eligibility.
Maximum monthly TEFAP income guidelines are listed on this form. The
new income guidelines should be reflected on all declaratory statement
forms, local applications and any other information used to determine
eligibility for participation in TEFAP. The new guidelines (effective
July 1, 1999) are as follows:

REQUIRED ACTION
In order to implement the
new income guidelines and to inform participating organizations of the
changes in this letter, it is necessary for SRS Area Directors to do
the following:
- Request from the SRS Food Distribution
Unit the total number of copies of this letter and manual revision
in order to provide the information to all TEFAP participating organizations
in their respective management areas.
- Distribute a copy of this letter with
the manual revision to all TEFAP participating organizations and
individuals having Kansas Commodity Distribution Manuals or TEFAP
implementation responsibilities.
- Remove page 2-3, Determination of
Income and page 2-4, Income Standards (Rev. 6/98). Insert
new pages 2-3, 2-4 (Rev. 6/99).
- Remove page 8-12, Exhibit E, Declaratory
Statement/Inventory Control (Rev. 6/98). Insert new page 8-12
(Rev. 6/99).
- Remove page 8-2, Exhibit A-2, Distribution
Area Contact Information (Rev. 6/92). Insert new page 8-2 (Rev.
6/99).
- Remove pages 8-3 and 8-4, Exhibit B, Agreement
to Receive and Use U.S.D.A. Commodities in Prepared Meals for Needy
Persons (Rev. 6/89). Insert new pages 8-3 and 8-4 (Rev. 6/99).
- Remove pages 8-6 and 8-7, Exhibit C, Agreement
to Receive and Distribute U.S.D.A. Commodities to Needy Persons For
Home Consumption (Rev. 6/89). Insert new pages 8-6 and 8-7
(Rev. 6/99).
EFFECTIVE DATE
All policy and procedure
changes detailed in this letter are effective July 1, 1999. The new
income standards should be used for all TEFAP eligibility determinations
completed on or after July 1, 1999.
