900-7 ADDING/GENERATING A NOTICE OF ASSIGNMENT

These procedures provide instructions for adding and printing any of the Kansas or out-of-state Notice of Assignment of Support Rights documents. These procedures assume that a legal action has already been added for the court order and the participants and their roles already exist in the system. If you do not have a copy of the petition you must add the petition legal action to the system and then you may generate an NOA. Once the petition is received from the court, select the legal action and update it with the caption, etc.

NOTE: The petition or journal entry legal action will list all of the children (LROL information). Therefore when an NOA legal action is added, it will list all of the children (LROL information) and pertain to all of the CSE cases related to the legal action. Do not add a duplicate NOA legal action if there is an active NOA legal action, unless the child (ren) were non case related and are now case related. If that is the situation, follow Business Practice 900-28 Adding/Generating A Notice of Assignment For A Child Who Was A Non-Case Related Person and Is Now A Case Related Person and generate another NOA. This NOA will re-list the children on the previous NOA and include the additional children.

NOTE: If a copy is needed for paper files in other CSE offices, staff in that office may make a copy by selecting the NOA legal action on ODCM (Outgoing Document Maintenance), press PF24 (print) to download the document for your file. If the cases are in the same CSE office, copies can be made and dispersed.

Next to LACN:

1. On LACN:

NOTE: If the legal action was just established by CSE, there is only one CSE case associated to the legal action and the user knows an NOA does not exist on this court order number, LACN does not need to be checked.

If there is an NOA in effect (no partial or complete termination notice created after the NOA), do not add another NOA legal action unless the child (ren) were non-case related and are now case related. If that is the situation, follow Business Practice 900-28 Adding/Generating A Notice of Assignment For A Child Who Was A Non-Case Related Person and Is Now A Case Related Person and generate another NOA.

If an NOA has not been done for the court case number follow the rest of the business practice steps.

--Type LACT in the Next field and press <Enter>--

2. On LACT:

--Complete the required fields--

Classification: N

Court Case Number

Trib (Type AS@ in the prompt field. Press PF4, select the appropriate tribunal and press PF9 return)

Action Taken (Type AS@ in the prompt field. Press PF4, select the action and press PF9 to return to LACT)

Leg Act Est by: CS

Complete other fields as applicable.

If the assignments do not need to be changed:

--Press PF 5 (Add)--

NOTE: If all legal roles have not been added previously, the system will automatically flow to LROL and you should proceed to step 3. If legal roles have been added previously, but the paternity indicators have not been updated previously, the system will flow to CPAT and you should proceed to step 4. If legal roles and paternity indicators have both been updated previously, the system will copy legal assignments from the previous legal actions. If the assignments need to be changed, press PF18 to access ASIN and proceed to step 5.

3. On LROL:

--Enter the CSE Case number for the legal action--

--Press PF17 to get a listing of the people on the CSE case with their roles. If persons from other cases need to be added to the court case, move the cursor back up to the blank CSE Case # field, enter the other CSE case number, and press PF17 again. Repeat if more case numbers are needed. You can add additional cases by pressing PF8 when the first five cases are used on the first page. The system will take you to the second page and a line will appear--.

--Enter--

AS@ in the Sel field opposite the name of each person you want to include in the legal action.

P/R/C (P=Petitioner; R=Respondent; C=Child, as applicable for each person)

If appropriate, select the person again on the other CSE case and assign the same legal role. For example: If the children on this court order are on two separate cases with the same AP, respondent, the AP is selected on each case and assigned the R legal role. Legal role assignments must be made for every applicable CSE case. This establishes the tie from the legal action to the CSE case.

Effective Date (use filed date)

--If persons on the court order are not on a CSE case, PF18 to NAME, search and display the person on NAME, select and PF9 Return to LROL. (See Business Practice 900-22 Adding a Non-Case-Related Person to a Legal Role and a Legal Obligation Role for a Legal Action)--

--PF5 (Add)--

NOTE: If the paternity indicators on CPAT have not been updated since the case opened and are still set at the default values, the system will automatically flow to CPAT to update the indicators and you may proceed to step 4. If CPAT indicators have already been updated, the system will automatically flow to ASIN and you may proceed to step 5.

4. On CPAT:

--Select a child and update the values for Born out of Wedlock (BOW), CSE to Establish (CSE to Est) and Paternity Established (PE), if necessary--

Valid combinations of codes at this time are:

BOW = Y, CSE to EST = Y, PE = Y

BOW = Y, CSE to EST = Y, PE = N

BOW = Y, CSE to EST = N, PE = Y

BOW = Y, CSE to EST = U, PE = N

BOW = N, CSE to EST = N, PE = Y

--If available, enter the information on the father=s name and signature on the birth certificate--

--PF6 (Update). Repeat for each child on the case--

--PF9 to return to ASIN--

An assignment for both EST and RSP must be in effect. This assignment is used to download documents, create monitored activities and generate reports. If the case is not referred to an attorney, you must select the attorney that will be signing the NOA (KS NOAs). (Out of state NOAs can be assigned to someone other than an attorney)

5. On ASIN:

To assign the Legal Action to a Service Provider other than the one displayed on ASIN:

--Enter AS@ in the Sel field beside a blank record--

--Enter Reason--

--Select the Service Provider to whom to assign the Legal Action--

--Type AS@ in the prompt field following the Serv Prov field--

--Press PF4 (List). The system will automatically access Maintain Service Providers in an Office (SVPO)--

6. On SVPO:

--Enter the office number for the Service Provider in the Office No field--

--Press PF2 (Display)--

--Type AS@ in the Sel field by the appropriate Service Provider=s record--

--Press PF9 (Return). The system will automatically return to ASIN with the Service Provider ID selected--

7. On ASIN:

--Press PF5 to add the assignment record. The old assignment will be ended and the new assignment will be effective with tomorrow=s date--

--Press PF9 to return to LACT--

8. On LACT:

--Enter the Filed date (use today=s date)--

NOTE: The filed date is mandatory. If it is not entered, the system will not allow the same NOA legal action to be added in the future because it will appear to duplicate an existing legal action.--

--Press PF6 (Update)--

--Press PF24 (Print). The system will download the document--

If there is missing information needed to download the document, the system will flow to DDOC (dead document) and provide a message indicating what information is needed to download the document. If the highlighted field is green, the user will need to input information on the line provided. If the highlighted field is red, the user must enter the information in a field (s) in the system before the download can be completed. You may need to scroll through the pages of this screen to see what is highlighted. If the information missing needs to be added to the case, press PF9 (Return) and go to the appropriate screen, add data, return to the screen and try printing again.

Edit, paying special attention to the areas of the document that are in red, making sure the data downloaded is correct.

Save and print the document.

Exit the document and return to the LACT screen by clicking on the session bar.

NOTE: NOAs must be reviewed. The system may not complete all necessary fields on every NOA document. In caretaker situations, the system downloads the AR on the NOA. The system does not download non-case related persons. These persons should be assigned legal roles on LROL but the document will have to be edited to add these names if appropriate. (Ex: There may be past due alimony assigned to the state and the AR may be a non-case related person). If the legal action is associated to more than one CSE case, the system will find the service provider for one case and enter that name on the document. If that isn=t appropriate the service provider needs to be changed on the document.

Copies of NOAs should be made and filed in all associated CSE Case files. Only one original NOA with a copy of the NOA should be sent to the court. The court should file stamp the copy and return it to the office. Upon receipt of the file stamped copy, the correct filed date must be entered on LACT.

All Kansas NOAs must be signed or name stamped with the attorney=s signature. Exception: TERMASSN (Notice Term Assignment-KS) which must have an attorney signature.
