1000-12 CSE PERSON REQUESTS AN ADMINISTRATIVE APPEAL

These procedures assume that a CSE person is requesting an appeal in his/her own behalf for the first time. Usually requests are received because of a federal or state tax offset. To initiate a request, the CSE person may make the request verbally or in writing. However, it is necessary to obtain a completed Administrative Appeal Request For Fair Hearing, or written request, before printing any appeal documents.

Next to AAPP:

1. On AAPP:

--Enter if written request is received--

Person number or Social Security Number.

Administrative Action Type (if appropriate.)

Taken Date (if it exists for the Administrative Action Type)

NOTE: In the case of SDSO and FDSO where multiple taken dates exist, select the most recent taken date prior to the request date for the hearing. Record in the reason field the specifics of the appeal request. For example, an obligor appealing Federal salary but not other Federal offset actions. If the appeal is for multiple appeal types such as FDSO and Fair Hearing, both issues could be heard in the same hearing. If this situation occurs, add the appeal record for FDSO and record in the reason field that there is an additional fair hearing issue to be resolved in the hearing.

--For FDSO and SDSO enter--

Request Date (Must be entered if Type is entered)

Received Date (if Administrative Appeal Request For Fair Hearing or written request received)

Review State (Defaults to KS unless entered.)

--Press PF5 to add the new request--

--Press PF20 to go to ASIN--

2. On ASIN:

--Enter--

S in the Sel field.

Effective (today=s date)

Reason: RSP

--Select the Service Provider to whom to assign the Administrative Appeal--

Type AS@ in the prompt field following the Serv Prov field.

Press PF4 to go to SVPO.

3. On SVPO:

--Enter the office number of the Service Provider for whom the assignment will be valid in the Office Number field-

--Press PF2--

--Type AS@ in the Sel field by the appropriate Service Provider=s record--

--Press PF9. The system will automatically return to ASIN with the Service Provider ID selected.--

4. On ASIN:

--Press PF5 to add the assignment record. All AAPP documents downloaded will use the assigned service provider on the document--

--Press PF9 to return to AAPP--

5. If a verbal request is received:

--Follow all steps in #1, except a received date is not entered--

--Press PF5 Add--

--Press PF24 to access document List (DOCM)--

6. On DOCM:

--Type S in the Sel field opposite Administrative Appeal Request for Fair Hearing--

--The system will download the document to WordPerfect--

Note: If there is missing information needed to download the document, the system will flow to DDOC (dead document) and provide a message indicating what information is needed to download the document. If the highlighted field is green, the user will need to input information on the line provided. If the highlighted field is red, the user must enter the information in a field (s) in the system before the download can be completed. You may need to scroll through the pages of this screen to see what is highlighted. If the information missing needs to be added to the case, press PF9 return and go to the appropriate screen, add data, return to the screen and try printing again.

Edit, paying special attention to the areas of the document that are in red, making sure the data downloaded is correct.

Save and print the document from WordPerfect.

Make a copy for the CSE file.

File a copy of the letter in the CSE file.

Exit WordPerfect (PF9 return) to the AAPP screen.

NOTE: When the Request For Fair Hearing document is returned, follow procedures as outlined in Business Practice 1000-14 Updating Administrative Appeals Information.
