Kansas statutes (H.B. 2561) provide that: ANo individual shall be considered a resident for purposes of general assistance..... if such individual owns an-automobile or other motor vehicle which is not registered in this state but which is required by law to be registered in the state." This statute prohibits GA eligibility for persons moving into Kansas from other states who do not register their vehicles in Kansas as prescribed by the "Reciprocity by Jurisdiction" policy.
Kansas utilizes the "Reciprocity by Jurisdiction" policy when a person moves into Kansas with the purpose of establishing residence. Essentially, we "mirror" the other state's policy relative to vehicle registrations. Thus, the length of time a person has to register their non-exempt vehicle in Kansas is dependent upon the person's prior residence.
Attachment A establishes the Kansas policy for vehicle registrations. Following are several examples on how to use the listing when a person moves to Kansas from the surrounding states.
Colorado - Kansas registration is required within 30 days upon establishment of residence. If a person moves to Kansas from Colorado on July 15 with the intent to establish residence, GA can be provided for up to 30 days. In this example, if the person fails to register their non-exempt vehicle within this 30 day period, the GA case must be closed August 31 (calendar month concept). Assistance cannot be reinstated until the vehicle is properly registered.
Nebraska - Kansas registration is required by the time the Nebraska registration expires or December 31, whichever comes first. If a person moves to Kansas from Nebraska on July 15 and his Nebraska registration expires September 30, any non-exempt vehicle must be registered by September 30. GA eligibility ceases as of September 30 if the vehicle is not registered. (The providing of timely and adequate notice may require extending assistance for an additional month.)
In the above example, if the Nebraska registration expires on March 31, 1991, then GA eligibility would cease as of December 31, 1990 if the vehicle is not registered.Missouri and Oklahoma - Kansas registration is required immediately upon residence. If a person moves to Kansas from Missouri or Oklahoma on July 15, there would be no GA eligibility until after the person's non-exempt vehicle is registered in Kansas.
It should be noted that the column entitled "Non-Resident Privilege" permits non-residents to operate vehicles in the State without a Kansas registration.
For GA purposes, ownership of junk cars and other inoperable vehicles that are on private property and not driven on streets and highways shall not adversely affect eligibility. If a client states that he owns such a vehicle, his statement should be accepted unless circumstances indicate otherwise. In addition, certain vehicles are specifically exempted. Attachment B sets out those vehicles that are exempt from registration.
The GA Vehicle Registration policy became effective July 1, 1989. Any person who owns a vehicle that is required to be registered in Kansas, but is not registered, shall be ineligible for GA. An individual who has registered his or her vehicle in Kansas in the past but has let that registration lapse, shall be considered to have met this requirement.
In accordance with the GA filing unit provisions of KEESM 4112, ownership of a nonexempt vehicle that is not registered in Kansas shall result in ineligibility for the individual and all mandatory filing unit members unless the individual who owns the vehicle is specifically excluded from the mandatory filing unit in accordance with KEESM 4113.

ATTACHMENT B
KANSAS VEHICLE REGISTRATION
WHEN REQUIRED
Any resident or non-resident of Kansas intending to operate a vehicle upon any highway of this state must first obtain a vehicle registration, unless specifically exempted.
Vehicle Registration Exemptions
The following vehicles are exempt from Kansas registration:
1. Farm tractors and all self-propelled farm implements, including fertilizers and spreaders designed and used exclusively for dispensing liquid or dust fertilizer;
2. Fertilizer trailers used and designed for applying fertilizer. Truck mounted fertilizers used or manufactured principally to spread animal dung will NOT be exempt from registration as an implement of husbandry.
3. Farm trailers with a load not exceeding 6,000 pounds, registration is optional;
4. Registration is optional for trailers having a gross weight of 2,000 pounds or less.
5. Road rollers and road machinery temporarily operated or moved upon the highway;
6. School buses owned and operated by a private school or school district, which have the name of the private school or school district plainly painted thereon;
7. Self-propelled cranes and earth moving equipment which are equipped with pneumatic tires, provided however, that they shall not be operated on state maintained roads or highways on Saturdays, Sundays or legal holidays;
8. Vehicles transferred in ownership . by operation of law-when such vehicles are not operated on the highways of Kansas. This applies to vehicles transferred due to inheritance, a surviving spouse, repossession, mechanic's or storage lien, abandonment, divorce, or confiscation;
9. Vehicles title as non-highway;
10. Any vehicles driven or moved upon the highway in conformance with the provisions relating to a non-residents, Vehicle manufacturers or vehicle dealers (see separate sections on these exceptions).,
11. Low power cycles defined as 'every vehicle and every bicycle and tricycle with not to exceed one brake horsepower provided by battery in addition to human power';
12. Municipally owned fire trucks or privately owned fire trucks subject to a mutual aid agreement with a municipality; and,
13. All-terrain vehicles.
