2520 Able-bodied Adults Without Dependents (ABAWD) - Able bodied adults aged 18-49 without dependents in the home, can only receive food stamps for 3 months in a 36 month period while they are not meeting the work requirement of items 1 or 2 below. For ease of administration and tracking, the State is adopting a FIXED 36 month period for all person's identified as ABAWD's in the State. The current 36 month period is 1/2006 through 12/2008. In addition, the tracking of receipt of food stamp benefits as an ABAWD shall only be based on receipt of food stamp benefits from Kansas.

Effective May 1, 2008 through April 30, 2009, residents of the following 27 counties and one city are exempt from the ABAWD criteria of this section for one year.

Examples: ABAWD A gets 3 months of food stamps while not meeting the ABAWD work requirement from 7/2006 through 9/2006. Unless they qualify for the one-time 3 month extension, ABAWD A cannot receive food stamps again without meeting the work requirement until 1/2009. ABAWD B gets 3 months of food stamps while not meeting the work requirement from 10/2006 through 12/2006. Since the fixed 36 month period for the State of Kansas will end in 12/2008, ABAWD B can get 3 more months of food stamps starting 1/2009. ABAWD A can also get 3 more months of food stamps starting 1/2009. If ABAWD A and B get their 3 months in the fixed period of from 1/2006 to 12/2008, neither can get food stamps again until 1/2009 unless they meet the work requirement, qualify for the one-time 3 month extension, or become a non-ABAWD.

 

To receive food stamps past the 3 month period, the individual must meet the following work requirement:

 

  1. Working at least 20 hours per week (averaged monthly), earning at least minimum wage, or

    NOTE:
    If an individual would have worked an average of 20 hours per week, but missed some work for good cause, the individual shall be considered to have met the work requirement if the absence from work is temporary and the individual retains his or her job. Good cause shall include circumstances beyond the individual's control, such as, but not limited to illness, illness of another household member requiring the presence of the member, a household emergency or the unavailability of transportation.

    NOTE: Verification that the individual is working an average of 20 hours a week is mandatory. See 1322.1 (8).

    NOTE:
    An individual employed by VISTA an average of 20 hours a week would meet this criteria even if the income is not countable. In addition, in-kind income would also count for meeting the ABAWD work requirement as long as the person is working an average of 20 hours a week and receiving in-kind value of at least minimum wage.

     

  2. Participating in and complying with a WIA or Trade Adjustment Assistance Act (TAAA) program for 20 hours or more per week.
